POSITIVELY ESTABLISHED, NOT ASSUMED. Three independent checks on the official Attorney General's Office legislation site (ago.gov.to — the Government of Tonga's authoritative legislation repository): (1) The AGO alphabetical index of ALL legislation in force (principal Acts AND subsidiary legislation — it lists items down to the Public Health (Meat) Regulations 1967) contains NO 'Minimum Wage Act', no minimum wage order and no minimum wage regulations; the only wage-related instrument of any kind in the whole index is the Price and Wage Control Act 1947. (2) There is NO general employment/labour statute in force at all — the index contains no Employment Act, no Labour Act and no Employment Relations Act. The Employment Relations Bill 2020 exists on the AGO site only as a BILL (LEGISLATION/BILLS/2020/2020-0003/EmploymentRelationsBill2020.pdf) and has never been enacted; it is the vehicle a minimum wage would have arrived in. (3) The only enabling power that could produce a minimum wage is s.5 of the Price and Wage Control Act 1947 (CAP. 17.10), quoted in the source field: it is permissive ('may, in his discretion'), requires Cabinet approval to commence, and requires the Competent Authority to weigh 'economic conditions, employment situation and wage levels generally prevailing in the country... capacity of the employers to pay, cost of living' (s.5(3)). No order made under it is in force. The 2020 Revised Edition of that Act carries an explicit NOTE under SUBSIDIARY LEGISLATION: 'Price and Wage Control Orders, being temporary in nature, are omitted from this Edition' — i.e. the revisers treat any such order as transient, and none is currently indexed. Note that s.2 of the Act binds the Crown as to wages, and 'employee' expressly includes civil servants, so the mechanism would cover the public sector too if ever used. WHAT MUST NOT BE SUBSTITUTED: (a) the Tongan public service salary scales/bands — those are remuneration for government employment set under the Public Service Act 2002, binding on no private employer, and are not a statutory floor; (b) ILO, World Bank or employer-of-record 'estimated' or 'prevailing' wage figures — several commercial HR/EOR aggregators publish a TOP figure for Tonga; it has no legal basis and is not served here; (c) sector or collective-agreement rates — Tongan wages are set by individual contract and market practice, with no erga omnes extension mechanism. value is null with unit and effective_from also null because there is no instrument to date.
