SCOPE — POST-JUDGMENT only, at 4% per annum, running from the time judgment is entered up until it is satisfied and leviable under a writ of execution. Fiji has no statutory late-payment interest on commercial invoices: outside contract, a creditor gets interest only through the court. THE STATE EXCEPTION IS THE BIG TRAP: s. 4(3) provides that notwithstanding the section, the State Proceedings Act or any other written law, NO interest is payable on a judgment debt entered in proceedings against the State or the Attorney-General. A money judgment against a Fijian government defendant carries 0%, not 4%. THE COURT CAN SWITCH IT OFF: s. 4(2) allows rules of court to provide for the court to disallow all or part of the interest otherwise payable — so 4% is the default, not an absolute entitlement. DRAFTING QUIRK: the Decree's operative words are 'four cents per centum per annum'; this is read and applied as four per centum (4%) per annum. BEFORE 2011 THERE WAS NO STATUTORY POST-JUDGMENT RATE — Cap. 27 as originally enacted (Ordinance No. 7 of 1935) contained only three sections and no judgment-debt provision; s. 4 was inserted by Decree No. 46 of 2011, made 28 October 2011 and in force on its publication in the Gazette. Judgments entered before that date are not governed by this section. PRE-JUDGMENT INTEREST IS DISCRETIONARY: s. 3 lets the court, if it thinks fit, include in the judgment sum interest 'at such rate as it thinks fit' on all or part of the debt or damages for all or part of the period between accrual of the cause of action and judgment, subject to the usual three carve-outs — no interest upon interest, no application where interest is payable as of right by agreement or otherwise, and no effect on damages for dishonour of a bill of exchange. There is no fixed pre-judgment percentage. Section 3 is worded as a power of the 'Supreme Court', which is the pre-1990 name of what is now the High Court of Fiji. Simple interest; no compounding provision. No civil/commercial split.
