THIS IS A COURT-RULE RATE, NOT A STATUTORY ONE. No Solomon Islands Act fixes an interest percentage. The 5% comes from the Civil Procedure Rules made by the Rules Committee under section 90 of the Constitution, and the Rules Committee can change it without Parliament. It is also a DEFAULT, not an entitlement: r. 17.72 applies 'unless the court otherwise orders', and any party may apply under Chapter 7 (Interlocutory Applications) for a different rate. SCOPE: post-judgment, on the amount of a judgment debt unpaid on and after the day judgment is entered. The Rules govern civil proceedings in the High Court and, under s. 76 of the Magistrates' Courts Act [Cap. 20], the Magistrates' Courts. TWO CARVE-OUTS THAT CATCH PEOPLE OUT: (1) 28-DAY GRACE — unless the court orders otherwise, NO interest is payable at all on the judgment debt if it is paid in full not later than 28 days after the day the judgment takes effect (r. 17.73). A debtor who settles inside four weeks owes nothing extra. (2) COSTS ARE EXCLUDED — the judgment debt for this purpose is 'other than costs', and interest is not payable on any amount awarded for costs unless the court orders it (r. 17.74); where the court does order it, the rate is again 5% per annum, running from the day the costs were assessed or another date the court decides (r. 17.75). PRE-JUDGMENT INTEREST IS DISCRETIONARY WITH A 5% ANCHOR: under r. 17.65 the court may include interest in the judgment sum 'at the rate of 5 per cent per annum or such other rate it considers appropriate', on all or part of the money, for all or part of the period from the day the cause of action arose (or a later date the court decides) to the day before judgment is entered — or may substitute a lump sum instead of interest. Rule 17.66 forbids any such interest or lump sum for loss to be suffered AFTER judgment, or on aggravated, exemplary or punitive damages. NO LATE-PAYMENT REGIME: nothing gives a Solomon Islands creditor default interest on an overdue invoice outside contract or a court order. Simple interest; the Rules provide for no compounding.
